2018-2019 INTERNATIONAL COMMERCIAL ARBITRATION SWANSEA UNIVERSITY SCHOOL OF LAW SHIPPING AND TRADE LAW (LACM17)
Guidelines and Information
This assessment accounts for 25% of the course’s total grade.
Students must respond to the linked question with a well-thought-out response. The examiners are searching for a well-thought-out analysis and, when necessary, some creativity. Credit will be given for accurately identifying legal issues and suggesting reasonable and imaginative remedies, as long as they are always backed up by reasoned arguments and legal authority. Repeating the essay question/facts given in the problem in your solution will not earn you any points.
Plagiarism of another author’s work, especially that of a student, is a serious academic offense. “Turnitin” will check your homework for plagiarism (Plagiarism Detection Software). Footnotes must explicitly acknowledge quotations from legal sources. Students who engage in such behavior will face disciplinary action.
Your homework should not exceed 2.500 words. You must specify the total amount of words at the conclusion. A reduction from your grade will be applied if you exceed the word limit (unless in circumstances where a de minimis criterion applies). Regulations at the college/university will decide the exact deduction. Incorrectly stating the word limit will be viewed as an attempt to gain an unfair advantage, and disciplinary action will be taken.
The coursework question will be posted on the LLM Blackboard site on May 10th at 9:00 a.m. through the relevant module.
On the LLM Blackboard site, you must submit an electronic copy of your coursework solution to the relevant module. The deadline for submissions is May 10, 2019 at 4.30 p.m. All pages should be numbered.
Students must submit a Deferral Form to the Shipping and Trade Law Assessment and Progression Committee if they were unable to submit due to extenuating circumstances.
The form must be submitted either before the deadline or within 5 days before the deadline for the short-term coursework in question. Please keep in mind that a student claiming that extenuating circumstances influenced his or her work will be required to produce relevant evidence, such as medical certifications, to back up his or her claim. Students who have valid extenuating circumstances will be given a second chance to complete and submit the short-term coursework. This can happen after the exam period in May/June and, in certain situations, during the re-sit exam session in August/September.
It is your obligation to double-check and finish your coursework before submitting it. Once you’ve submitted your coursework, you won’t be able to view it again until it’s marked and returned.
On Blackboard (left-hand corner), watch the video ‘KEEP CALM AND TURNITIN’ to learn how to submit your work online via Turnitin. Please use only your student number as the file name in your Turnitin electronic submission, not your name and surname.
ON THE NEXT PAGE, THE QUESTION BEGINS.
A contract for the sale of goods governed by English law between Swansea plc (having its principal place of business in Swansea) and Antwerp plc (having its principal place of business in Antwerp, Belgium) contains the following arbitration clause: “All disputes arising under this contract shall be referred to the final and binding decision of a tribunal of three arbitrators.” Swansea plc is considering taking Antwerp plc to arbitration for breach of contract. Antwerp plc, on the other hand, claims that the sale contract was forged as a result of the bribery of its Vice President of Sales, and that as a result, the contract is null and void.
Swansea plc’s in-house legal counsel has requested your legal assistance on the following relevant issues:
(a) Do the arbitrators have jurisdiction to decide the issue, given that Antwerp plc claims the contract of sale is void for illegality?
(a) What remedies does Swansea plc have if Antwerp plc refuses to participate in the appointment of the arbitrators?
(c) What are Swansea plc’s alternatives for enforcing the arbitration agreement if Antwerp plc files a claim against it in the High Court of London?
(d) Can Antwerp plc dispute the arbitrators’ final award under Sections 67 and 69 of the Arbitration Act 1996 if it does not participate in the arbitration?
