1. Gabriel Harris has an IQ of 72. The 22 year old is classified as borderline retarded. Five years ago, Harris was seriously injured in an assault. He suffered a broken skull. Harris now has a metal plate in his head. As a result of the assault, Harris suffers from memory lapses and seizures. He also experiences trauma-induced psychosis. Harris takes psychotropic medication to control his auditory and visual hallucinations. Six months ago, Harris witnessed an event at Walmart. Franklin Thomas contends that he was injured due to the negligence of Walmart. Harris was the only non-party witness to the event. Thomas wants to call Harris as a witness at his upcoming civil trial. Walmart is challenging Harris’s competence as a witness. What should the trial court do? How should the trial court rule on Walmart’s application? Explain.

3. Allen Purnell died last month at the age of 62. His estate is now in probate court. Purnell’s family produces Purnell’s will from 2000. The will evenly divides his estate among his four children. The Purnell family lawyer, who prepared the will, brings the original signed and witnessed document to court. Purnell was terminally ill with cancer the final year of his life. He died in hospice care. His final caregiver, Ethel Simpson, brings to court a computer disc. On that disc is a new will that was dated one month before Purnell’s death. In that new will, Purnell disinherits his entire family. He claimed that his family did not help him in his time of need. As a result, Purnell made Simpson his sole beneficiary. The new will does not bear Purnell’s signature. Instead, it only bears an X instead of a signature. Simpson explains that Purnell did not have the physical capacity to sign his name. Instead, he could only push the letter X on her computer. Purnell’s doctor verifies that Purnell lacked the physical capacity to sign his name in the last three months of his life. Purnell’s family challenges the authenticity of the new will. What must the probate court do? How should the probate court decide this case? Explain.
4. Michael Burns, who is 35 years old, has been charged with armed robbery. Burns claims that he was home alone watching television at the time of the bank robbery. He is the sole source of his alibi defense. If Burns takes the witness stand at his trial, the prosecution wants to impeach him with his prior criminal record which includes misdemeanor convictions for criminal possession of a controlled substance (cocaine) in 2005, 2007, 2009, 2011 and 2012 and misdemeanor convictions for petit larceny in 2006, 2008, 2010 and 2012 as well as a felony grand larceny conviction in 2013. Burns was sentenced to a year in prison for his felony conviction. He served short jail sentences for his misdemeanor convictions. Burns has no criminal record since his release from prison in 2014. He also completed a substance abuse program while incarcerated and has been drug-free since his release from prison. The prosecution wants to cross-examine Burns about each of these convictions and their underlying facts. The defense opposes the prosecution’s application.
