Description of the question
The Employee Who Was Fired
Susan Birch, the Acme Trailer Company’s vice president, had a stellar reputation as a knowledgeable and trustworthy finance officer. She, her husband, and their two children lived in a large, comfortable home in a lovely suburb. Birch was approached by the president of a competitor company, International Trailers Ltd., who wanted to hire her for a comparable role and offered her a higher pay and a slew of other advantages. She had a long phone talk with the President of International regarding this offer. Birch accepted the job offer, sold her house, and relocated to the city where her new employer was located. She didn’t have a written contract, but she was informed she had a bright future with the company and was granted a salary of $150,000 per year for the first two years, with the prospect of a promotion every six months. After 18 months in the work, she may be eligible for a bonus.
Birch was sacked four months after starting with the company due to a slowdown in the trailer manufacturing industry, which forced International to cut costs. She filed a lawsuit against International for breach of contract.
The Case
Susan testified at the trial about the good name she had acquired at Acme Trailer and the beautiful life she and her family had lived. She described the hardships of relocating, the costs of purchasing a new home, and the uprooting of her family. She described the challenges she faced in selling her new home and finding a new job.
An International officer testified about the trailer industry’s recession and how, if it didn’t slash costs, the company would be put out of business.
The Trial Arguments
Susan’s lawyer stated that, despite the lack of a written contract, oral representations made to her implied that her position would remain longer than a year; the fact that she would be paid on a yearly basis implied that her employment would extend at least two years. The counsel emphasized the hardships of the move and the expenses incurred by the Birch family, saying that terminating her work for reasons unrelated to her conduct would be unjust. The “employment at will” doctrine was also argued to be an outdated and unfair idea that should not be applied in this instance based on the facts.
International’s lawyer argued that the lack of a written contract and the existence of the “termination at will” doctrine in the state where International was based gave International the right to terminate Birch’s employment at any time for any reason, particularly when economic conditions necessitated cost-cutting measures, such as terminating the employment of executives with high salaries.
Questions for Consideration
Who do you believe should win this case, Birch or International, based on the facts? Why?
Is there any further information that would help the court decide who should win?
Do you believe the notion of employment at will should be abolished? If that’s the case, should the legislators or the courts make the changes? Why?
