- Executive and Judiciary are the inseparable components of any system of governance. It is possible and in some countries evident, that there can be interdependencies between the two systems of governance. However, ‘Sultanate of Oman’s judicial system is intended to be independent.’ Do you agree with this statement? Examine in depth. (5 marks)
- Hamza is a Major working in Royal Army of Oman. He is eligible for next promotion as Lieutenant colonel. However, his junior or same rank is given promotion. Mr.Hamza felt very bad. He wants to go to Administriave court to get his problem solved.
- Do you approve the action of Mr.Hamza going to court? Justify your answer. (1+1=2 marks)

Answer the following questions, which are related to Contract Law.
- Faisal purchased a new car. The car seller told that for every liter of petrol, the car will give 15 km mileage. However, when Mr.Faisal started using the car, he understood that it gives a mileage of 13 km per liter. For a layman, misrepresentation and fraud seem to be same.
In this scenario, can we say that there is fraud by the seller?Critically examine the delicate difference between Misrepresentation and Fraud, with different examples to prove the point. (5 Marks)
- Every contract creates rights and obligations. Is it a rule that always ‘obligations’ should arise out of contracts?
Discuss the above concept clearly along with giving clear examples to prove your point.

Answer the following questions, which are related to Oman Labor Law.
- Imran was working in Trinity Software LLC in Muscat as a Computer Programmer. His service record shows that he worked in the company from 7th December 2008 till 7th December 2016. At the beginning of his career he was getting a Basic salary and Gross salary of 600 pm and 1000 pm respectively. At the time of leaving the job, his both salaries increased by 20%. After careful examination of Mr.Imran’s service record, Company’s accountant identified that there is a service break. Accountant noticed that there was an unapproved break of exact one year in the service of Mr.Imran after exactly four years from the start of his career with Trinity Software.
You are required to calculate the amount of Gratuity of Mr.Imran.
Show all the steps and calculations clearly. (5 Marks)
- Khalid,an employee of a private company met with an accident and had to take sick leave for 70 days. His monthly salary is RO. 988. Mr.Hamdan produced all necessary documents to prove his case.

Answer the following questions, which are related to Commercial Companies Law of Oman.
Amal, Abeer and Amna are close friends and wanted to start a commercial company. They started their business in 2015 January, with a capital of 20,000 RO. The investment ratio of all the investors was 4/10, 3/10 and 3/10 respectively. They have fixed the profit/loss sharing ratio on the same lines of investment ratio. However, they have agreed that for the debts of the business Amal and Abeer only should take full responsibility.
The financial results of their business for the years 2015, 2016 and 2017 were: (-1200 RO), (2000 RO), and (-800 RO). At the end of 2028 After running their business for four years, they had a total debt of 45000 RO. The three friends decided to close the business.
- It appears that the three friends started an Oman Public Joint stock company. Is it true? If not true, which is the Commercial Company the three friends started? What kind of liability the friends have chosen? Explain it. Write any three features of the company they started. (2+0.5×3=3.5 Marks)
- What is the investment of each person in the above named business? (1.5 Marks)
- With the financial results given, calculate each person’s profit/loss for each year and total profit/loss. (2 Marks)

Answer the following question, which are related to Commercial Companies Law of Oman.
Jupiter Holding Company is a reputed company in its area of activities. Jupiter has paid-up share capital which is two and half times (2.5 X) more to the capital as prescribed by law as minimum capital and is divided into equal number of shares of RO 1 each. It has five founders. All of them put together, they have minimum shareholding as prescribed by law, and out of that, all have equal shares holding. For want of more funds, the company has taken different steps including inviting subscriptions from public.
Ms.Salma, Ms.Amal and Ms.Wafa are colleagues, working in very profitable company. They all are quite aware of financial markets and have investments in different companies.
All three colleagues made different investments in Jupiter. Ms.Salma purchased few financial instruments, which are having highest risk and at the same time give her control over theaffairs of the company.Ms.Amal purchased few financial instruments on which profits aredistributed if the company earns sufficient profit but they do not have the right to claimunpaid dividend which could not be paid due to insufficient profit. Ms.Wafa purchased fewfinancial instruments, which are having fixed maturity date and fixed rate of interest.
